For purposes of this Privacy Policy, “user”, “you”, and “your” means you (Executive, Consultant, Developer, or Information Technology Professional) as the user of our Digital Platform or Service.

This Privacy Policy aims to inform you about how DRAFT4 processes your data and about the commitments made by DRAFT4 to respect your privacy.

The information we may collect through our Digital Platform (Systems, website, partners third parties’ sites or systems, software, App, fill forms, submit a Job Requisition form, submit a Job Posting form, submit a CV), includes:

  • Name, Surname 

  • Date of birth 

  • Address(es) 

  • Phone numbers 

  • Mail address(es) 

  • Expertise and other types of skills 

  • Mobility and availability

  • Time zone preference

  • Professional background 

  • Educational background

  • Current and expected remuneration

  • Fees

  • Type of assignments sought 

All administrative information necessary for the drafting of a contract (bank details, social security number, CPF, and other necessary information)

 

All this information is not required at the time of registration; however, we invite you to communicate any information that could increase the efficiency of our services and improve the proposal of missions tailored to your profile.

4. How we collect your personal data

 

The first part of the data is collected during your online registration. Most of the information is collected through the form you fill out online, when you submit your CV, by telephone, or face to face interviews with our consultants. Your LinkedIn profile and other social media can also serve as a resource for our databases. We collect any professional feedback from the client company in the event of an assignment.

We also collect your personal data when you subscribe to newsletters offered by DRAFT4.

5. Purposes: we use your personal data

 

The information collected directly by DRAFT4 or through third parties is processed with the following goals: 

  • Analyze your profile to determine if your profile suits one of our client’s requirements.

  • Put you in contact with our clients regarding a job opportunity or an assignment.

  • If you agree, we will contact you regarding future opportunities that interest you.

  • Present your profile to our clients.

These data treatments are deemed as follows: 

  • Partly necessary, especially to deliver on pre-contractual measures, to analyze your profile to determine if an assignment could suit your profile.

  • Partly necessary, based on DRAFT4's legitimate interest in presenting interesting candidate profiles to its clients. 

Collecting your data also allows us to adapt our offer as best as possible so that any proposed assignment matches your skills and aspirations. We may also carry out satisfaction surveys and other statistical studies. 

Finally, certain information may be used to suggest that you participate in specific events deemed appropriate to your profile and send you newsletters by DRAFT4.

Data processing operations are based on DRAFT4's legitimate interest to improve both its services and your customer experience, as well as for commercial purposes.

6. How long we keep your data

 

We will keep your personal data as long as necessary to achieve the purposes according to which they have been collected and processed as described above. 

If one of our clients selects your profile, we will keep your data during the whole assignment’s length and until the authorized deadline, after which they will be deleted. 

If you eventually end up with no assignment, we will keep your personal data for a period of 24 months from your application, unless you wish otherwise

Beyond this period, your data will be archived for a period of 5 (five) years for the sole purpose of establishing, exercising, or defending legal claims.

 

7. Who has access to this information

We are committed to keeping this information strictly confidential. Only the following parties are entitled to access your personal data: 

  • DRAFT4 employees for which access to your information is required.

  • DRAFT4 partner companies in the sole case that their service delivery requires access to your data (IT maintenance, compliance check-ups, etc.). They have no right to collect your data though.

  • Companies (Clients) looking for DEVs (Consultants, Developers, Information Technology Professionals) for which your profile matches their requirements. In the latter case, your approval is a prerequisite before giving additional information. 

  • These third parties are bound by a confidentiality policy towards us.

 

8. Cookies Policy

9. Governing Law and Dispute Resolution

 

In the unlikely event we end up in a legal dispute, not depending on where you live or have your Company (Client), you and DRAFT4 agree to resolve it in the city of São Paulo courts, São Paulo State, Brazil, using Brazilian law.
